I. What is the privacy policy?

Privacy Policy is a policy that aims to inform our Customers about all aspects of the process of obtaining, processing and securing personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR). We hope that this Privacy Policy will help you understand what information we collect in connection with the activities of the Store and how we process it.

II. Your privacy is important to us

We protect your privacy at all times while using our Store. You can be sure that:

  • we comply with applicable legal regulations regarding the protection of personal data, which are collected as part of our Customers' use of our Store. Therefore, we need the following data to process orders: In the case of private orders: first name, last name, address, telephone number, e-mail address; in the case of corporate orders: first name, last name, company name, company address, Tax Identification Number, telephone number and e-mail address.
  • all information provided by the Client remains safe in our database. No unauthorized person has access to it. We ensure the security and protection of Clients' personal data, protecting and securing it against access by unauthorized persons in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 (GDPR)
  • we protect personal data from a technical perspective – we store them on top-class equipment in appropriately secured information storage centres, to which only authorised persons have access, using technical and organisational measures required by law to ensure their protection.
  • we do not transfer your data to unauthorized entities, with the exception of entities cooperating with us solely for the purpose of carrying out purchase and sale transactions (e.g. Poczta Polska, professional courier companies, the online platform shoplo, on which our store operates, etc.). In the event of detecting irregularities or threats caused by people who do not respect the laws and regulations in force within our Store, we cooperate with the police, prosecutor's office, courts to help catch people committing crimes.

III. What is the purpose of processing personal data?

  • In the case of a concluded sales contract, personal data will be processed in order to implement the provisions contained in the contract. The legal basis for the processing of personal data in this case is art. 6 sec. 1 letter b), i.e. processing is necessary for the performance of the contract and art. 6 sec. 1 letter f), i.e. the legitimate interest of the Administrator.
  • Personal data may be processed for the purpose of sending commercial information, including marketing information, regarding own products by electronic means and/or by telephone. The legal basis for the processing of personal data for marketing purposes is Article 6, paragraph 1, letter a), i.e. the consent of the data subject and Article 6, paragraph 1, letter f), i.e. the legitimate interest of the Administrator.
  • Personal data may be processed for the purpose of subscribing to the newsletter.
  • Personal data may be processed for the purpose of pursuing claims arising from the business activity conducted by moyha sc. The legal basis for the processing of personal data in this case is Article 6 paragraph 1 letter b), i.e. processing is necessary for the performance of the contract and Article 6 paragraph 1 letter f), i.e. the legitimate interest of the Administrator.
  • Personal data may be processed for the purpose of fulfilling legal and tax obligations in connection with the business activity conducted by moyha sc. The legal basis for the processing of personal data in this case is art. 6 sec. 1 letter b), i.e. processing is necessary for the performance of the contract and art. 6 sec. 1 letter f), i.e. the legally justified interest of the Administrator. The legal basis for the processing of personal data in this case is art. 6 sec. 1 letter a), i.e. the consent of the data subject. The option of receiving the newsletter is voluntary and the Customer may withdraw it at any time.

V. Are/will personal data processed in any other way?

As a business entity conducting commercial activity, we take care of the confidentiality of your data. Due to the need to ensure the appropriate organization of our company - e.g. in terms of IT infrastructure or current matters concerning our activity as an entrepreneur - your personal data may be transferred, i.e. disclosed or made available - to the following categories of recipients:

  • other business entities cooperating with moyha sc in the provision of services,
  • service providers supplying moyha sc with technical, IT and organizational solutions enabling the provision of services and management of our company (in particular, ICT service providers, courier and postal companies)
  • providers of legal and advisory services and those supporting moyha sc in pursuing its claims (e.g. law firms and debt collection companies). The legal basis for the processing of personal data in this case is Article 6 paragraph 1 letter b), i.e. processing is necessary for the performance of the contract and Article 6 paragraph 1 letter f), i.e. the legitimate interest of the Controller;

We would like to inform you that entities processing personal data on behalf of moyha sc operate under and on the basis of a data protection agreement (in accordance with Art. 28 of the GDPR), or on the basis of submitted confidentiality statements.

VI. How long are personal data processed?

We inform you that personal data will be processed for the period necessary to achieve the purposes listed in point III:

  • in the scope of implementation of the provisions contained in the contract – we store your personal data for the duration of the contract, as well as after its termination in order to pursue claims in connection with the performance of the contract, to fulfill obligations arising from legal regulations, in particular tax and accounting regulations, and for statistical and archiving purposes,
  • for marketing purposes - we store your personal data for the duration of the contract or until you withdraw your consent or object to such processing, whichever occurs first;
  • for the purpose of subscribing to the newsletter - we store your personal data until you withdraw your consent or object to such processing, depending on which of these events occurs first.

VII. When and under what circumstances do we obtain personal data from our Clients?

Each Customer can browse our website without disclosing their personal data. Providing personal data by the Customer is completely voluntary, but necessary in order to set up a Customer Account or place an order in the Store.

VIII. On what principles are the personal data of our Customers processed?

  • The provision of personal data by the Customer is voluntary, and some of them are necessary in order to set up a Customer Account or place an order.
  • The Store, as the personal data controller, applies appropriate technical and organizational measures to ensure the protection of the personal data being processed.
  • Every Customer has the right to access their personal data and to correct and delete them at any time, within their Account or by submitting such a request to the e-mail address shop@moyha.com
  • The Customer's personal data are processed for the purpose of executing the Order, proper implementation of services provided electronically, marketing of the administrator's own products and services.

IX. Find out what your rights are.

Remember that you have the right to access the content of your personal data processed by us and the possibility of correcting, updating, supplementing it, as well as requesting the cessation of processing of personal data and objecting to the processing of personal data.

In addition, we inform you that in the case of processing personal data based on expressed consent, all expressed consents to processing referred to in point 3 - may be withdrawn at any time. However, the withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

Customers also have the right to lodge a complaint with the supervisory authority.

X. What security measures do we use to protect our Customers’ personal data?

We use high-level security measures. Important security measures include transmission encryption (https) and password encryption.

The store uses technology that stores and accesses information on the user's end device (in particular using cookies).

Cookies are data, in particular text files, sent from a website server and stored by a web browser or other technological solutions on the end device (e.g. a personal computer or a mobile device such as a smartphone).

Cookies, in particular, make it easier for a user to use previously visited websites. If a user has used the same device and browser before, cookies enable their preferences to be remembered.

Cookies used in the Store primarily serve the proper functioning of the website and the convenience of visitors.

  • a change in the provisions governing the processing of personal data or services provided electronically, affecting the mutual rights and obligations of the Client and the administrator or a change in the interpretation of the above provisions as a result of court judgments, decisions, recommendations or recommendations of offices or bodies competent in a given scope;
  • a change in the method of providing services electronically caused solely by technical or technological reasons;
  • changing or extending the scope of services provided electronically by the administrator.

The announcement of changes will be made by placing information about changes to the Privacy Policy within the Store. With each change, a new version of the Privacy Policy will appear with a new date.

The Store does not automatically collect any information, except for information contained in cookie files.
